Factory License in Maharashtra – Updated Guide 2022

All the factories operating in Maharashtra are required to obtain a Factory License. As per Factories Act, 1948 a Factory means any premises where in 20 or more workers are working to carry out a manufacturing process with the aid of powers OR whereon 40 or more workers are working to carry out a manufacturing process without the aid of power.

Also Government has made this act applicable to power looms, saw mills, certain industries which use hazardous chemicals, and certain processes carried out using flammable solvents by publishing a notification, even if the number of workers are less than 10.

Prerequisites to apply for a Factory License

The prerequisite to register a Factory is as follows:

  • MPCB License Application – Maharashtra Pollution Control Board License
  • Company registration – The company should be incorporated

Appointment of Factory manager/ Factory Occupier

Process to apply for the factory license in Maharashtra ( Chakan, Pune, Talegaon, Bhosari, Ranjangaon)

After applying for MPCB license the factory license has to be applied in 2 stages:

  • Site and machinery layout plan approval under Factories Act 1948 by Filing Form 1
  • After the site plan is approved the Occupier files Form 2 for grant of license

Step 1 – Site and Machinery Layout plan approval

The site plan, building layout plan and plant & machinery layout plan along with sectional elevation in duplicate shall be submitted to the Directorate of industrial Safety & Health office along with form No 1 & questionnaire ( 10 र court fee stamp duly affixed ).

Detailed procedure to apply for approval of Site and Machinery Plan approval:

  1. Log on to the web site www.lms.mahaonline.gov.in
  2. Click on “Create Employer User Profile”.
  3. Fill the information and complete the Registration procedure on MAITRI portal.
  4. Fill the CAF (Common Application Form).
  5. Select the service provided as Approval of Plan from Directorate of Industrial Safety and Health Department.
  6. Read all the instruction carefully and confirm it
  7. Fill the Questionnaire
  8. Fill information and complete Form 1 and upload the duly signed copy of the same on the portal.
  1. Upload recent photograph and signature
  2. Upload necessary documents- list attached
  3. Pay the necessary fees online
  4. Send the two copies of plans as described below by speed Post or by Courier tracking system to the concern Directorate of Industrial Safety and Health office.
  • Plans (Site, Building layout, machinery layout and cross sectional elevation of building)(two copies each)
  • Site Plan drawn to scale 1:500 showing the site of factory and immediate surroundings including adjacent buildings and structure, roads, drains etc.
  • Building Plan, elevation, cross sectional elevation to scale 1:100 including all relevant details like natural lighting, ventilation,means of escape in case of fire etc.
  • Machinery layout to scale 1:100 shall clearly indicate position of machines/equipments, passages.
  1. The application and plans will be scrutinised by the department and if found ok, the Plans will be approved within forty five days.
  2. The Plan approval letter can be downloaded from the same login id.
  3. The application will be rejected if any incomplete or wrong information is furnished.
  4. The applicant can apply again within 30 days from the rejection.

Following documents shall be attached with the application for factory license.

  • Raw material list with maximum storage capacity and mode of storage.
  • Process flow chart
  • Finished product list
  • intermediate product list
  • MPCB consent
  • Allotment letter from MIDC / NOC from local authority.
  • NOC for PESO
  • Site approval from Director of DISH in case of solvent Extraction plant.
  • Brief Manufacturing process

After receiving the plans for approval from the management of the Factory, the DISH that is Director Industrial Safety and health scrutinizes the application and approves it or in case of any clarifications informs the management about the clarifications.

Step 2 – Appointment of occupier and application in form 2 for grant of factory license

  • After the approval of site plan, the occupier/factory manager will apply for grant of license by filing form 2 in triplicate
  • The officers of directorate will then visit the factory & if he finds that construction of the factory and machinery layout is as per the approved plan and if the conditions of plan approval are complied , then he recommends to Director Industrial Safety & Health for issuance of licence through his superiors and after getting the approval from the Director, licence is issued.

Documents to be submitted along with Form 2 for grant of factory License in Pune, PCMC and Chakan

  • List of directors and the copy of resolution mentioning the appointment of one of the director as occupier.
  • Receipt of the fees paid / challan copy as per the no of workers and HP (electricity)used.
  • Land purchase deed or leave and license copy,
  • rent receipt
  • 7/12 receipt
  • form 8(a),
  • M I D C allotment letter or any other document to prove the ownership or rent agreement.
  • Electricity Bill

Annual Compliances with regards to the factory license

An occupier of a factory is required to submit Annual Return in Form no. 27 on or before 1st Feb every year for the past calendar year.

Factory License renewal process

Factory license can be renewed by filing form 1 through online system on the portal “https://lms.mahaonline.gov.in”. The renewal application has to be filed before 31st October every year.

The additional fees of 5% fees has to be paid for every month of delay (maximum up to 25%). Factory License in Pune can be renewed maximum up to 10 years at any single time.

Amendment of factory license

The amendment of factory license can be applied by filing form 2. If the following changes the happen the amendment form has to be filed:

  • If there is change in name of the factory.
  • If there is change in number of workers,
  • Change in Horse power

Form no. 5 is required to be submitted if there is change in Factory Manager.

Registers and Documents to be maintained by every factory as per the factory Act, 1948

Each factory has to maintain the registers as mentioned below. It is the responsibility of the Factory occupier /Factory Manager to maintain these books:

In addition to this factory has to maintain health register in form 7.

Notice of period of work for adult workers in form 16 has to be displayed on the notice board and two copies are required to be sent to factories Inspector office.

A factory license application can be filed online on https://lms.mahaonline.gov.in/. There are 2 forms which need to be submitted with DISH ( Directorate of industrial Safety & Health office). Form 1 is for Site and layout approval and form 2 is for grant of factory License.

The detailed process is as follows:

  • 12. The application of the grant of license will be scrutinized by the department and if found ok, the conditional license will be granted within sixty days. (For Hazardous Factory)
  • 13. The issue certificate can be downloaded from the same login id
  • 14. The application will be rejected if any incomplete or wrong information is furnished.
  • 15. The applicant can apply again within 30 days from the rejection.

As per the Factory Act 1948 any factory having more than 20 workers and using electricity  or any factory with more than 40 workers is required to apply for the factory licenese.

It takes around 30-45 days to get a complete factory license registration.

Yes it is mandatory to apply for MPCB license before applying for factory license. Just the application acknowledgement is enough to start the process.
